Supreme Court Judgement file no. 32 Cdo 2892/2008

On 8th of the September, 2009 the Czech Supreme Court decided in favour of a client represented by DSB LAWYERS in which was ruled in order to unificate practise of courts:

"The Court of Appeal made serious misconduct by ​​improper application of the provisions of § 266 Commercial Code. According to its second paragraph, there should be applied in cases where the manifestation of will can not be interpreted in accordance with paragraph 1, the will shall be interpreted according to the meaning which would be normally attached by a person in position of the person who was a manifestation of will is intended."
